Alabama DUI Priority :
Under the Alabama drunk-driving law, it seems the first three convictions are treated as misdemeanors, for which the guilty can go to jail for up to a year. However, a fourth conviction is a felony, which can draw a sentence of up to 10 years in jail.

DUI & Driving Under The Influence:
DUI Meaning :
The specific criminal offense may be called, depending on the jurisdiction, driving while intoxicated (DWI), driving while impaired (also DWI), operating while intoxicated (OWI), operating a motor vehicle while intoxicated (OMVI), driving under the influence [of alcohol or other drugs] (DUI), driving under the combined influence of alcohol and/or other drugs, driving under the influence per se or drunk in charge [of a vehicle]. Such laws may also apply to boating, piloting aircraft, and even bicycling in some states such as California.

DUI Driving Drunk :
But the law was changed and changed again - strengthened, in fact, to be less tolerant of multiple convictions. But a provision that stipulated four convictions in five years was inadvertently left in. The high court indicated that it had little choice. It could not consider seven convictions in 15 years as constituting four in five years.

Then comes the case of a man who had seven drunken-driving convictions within 15 years, but only three within a five-year period. He was sentenced for committing a felony. He appealed. And the Alabama Court of Criminal Appeals reluctantly ruled that his sentence should be reduced.
